ZONING CODS <br /> SECTION 10.22, SUBDIVISION 2 (A) <br /> FILE #1609 <br /> y WHER$AS, A1 i ce L. Brock (hereinaf ter "the app 1 i cant") <br /> is the owner of the property located at 2780 Shadywood Road <br /> within the City of Orono (hereinafter "City" ) and legal ly <br /> described as Tract B, Registered Land Survey #1196, Hennepin <br /> County, Minnesota (hereinafter "the property"); and <br /> �1H$REAS, the applicant has applied to the City for an <br /> after-the-fact variance to Municipal Zoning Code Section 10.22, <br /> Subdivision 2 (A) to permit a 12'x32' deck at 384 s.f. that <br /> replaced a former 10`x28' deck at 280 s.f. resulting in a net <br /> increase of hardcover of 104 s.f. where 31.7� hardcover already <br /> exists within the 75-250' setback area where only 25$ is allowed. <br /> The second phase of the variance application involves a request <br /> by applicant for a 4'x48' second story deck along the east side <br /> of the house at a total of 195.2 s.f. of additional hardcover <br /> within the 75-250' setback area. The comprehensive application <br /> involves approval of an increase of 299.2 s.f. or 1.79$ of <br /> structural hardcover within the 75-250' setback area. <br /> NOT�T, THSREFORB, BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> FIPDINGS <br /> 1. This application was reviewed as Zoning File #1609. <br /> 2. The property is located in the LR-1B Single Family <br /> Lakeshore Residential Zoning District requiring 1 acre in <br /> area for each residential lot. The property consists of <br /> 17,544 s.f., exclusive of 1,030 s.f. for an access drive <br /> serving adjacent residence for a net area of 16,714 s.f. <br /> 3. 5,201.2 s.f. or 31.7� hardcover exists within the 75- <br /> 250' setback area.
