J � <br /> �\ <br /> ` � O� <br /> • O � O <br /> �b. - CITY�of ORONO <br /> � � <br /> '�' RESOLUTION OF THE CITY COUNCI L <br /> ��� �L � <br /> �kESHOg' NO. 6 �. � <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above fmdings, the Orono City Council hereby <br /> grants a variance to Municipal Zoni.ng Code Sections 10.22, Subdivision 2 and 10.56, <br /> Subdivision 16 (L) to permit the construction of a two story addition constituting additional <br /> hardcover in�the 75-250' zone in excess of the 25% hardcover normally allowed, subject to the <br /> following conditions: <br /> 1. Prior to footing inspection for the addition, applicants shall remove landscape bed <br /> . hardcover as shown on the sketch and list attached to this resolution as Exhibit <br /> A. Hardcover in the 0-75' zone shall be limited to 12 s.f. or 0.2%, and in the <br /> 75-250' zone shall be luruted to 5,770 s.f. or 31.7%. Applicants are advised that <br /> any future proposals to add hardcover on the property will require a variance <br /> application and might be approved only in conjunction with removal of equivalent <br /> � amounts of pre-existing hardcover. <br /> �2. The applicant shall obtain an af�er-the-fact building permit for the screen porch, <br /> � and a construction inspection shall be conducted by the inspection department. <br /> 3. Authorities granted by this variance run with the properry not with the applicants, <br /> but are permissive only and must be exercised by application for a building <br /> ' permit within one year of the date of Council approval, or this variance will <br /> expire on that date (October 9, 1996). <br /> 4. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> 5. The undersigned applicants have read, understood and hereby agree to the terms <br /> of this resolution and on behalf of themselves, their heirs, successors and assigns, <br /> hereby agree to the recording of this resolution in the chain of title of the <br /> property. . <br /> • Page 3 of 6 <br />� <br />
