� , <br /> � O� <br /> O �, O CITY of ORONO <br /> ��, <br /> ���`�-._, <br /> +-� � �% -';� D►► RESOLUTION OF TH ITY COUNCIL <br /> "�" f �Y �4• .:�`� ,�,�' 6 �� 7 <br /> � G NO. <br /> ��kESH�g'� <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants the <br /> following: <br /> a) An after-the-fact variance to Orono Municipal Zoning Code Section 78-1680 to <br /> allow installation of approximately 60 square feet of additional hardcover for the <br /> East Patio; <br /> b) An after-the-fact variance to Orono Municipal Zoning Code Section 78-1279 to <br /> permit construction of the East Patio 42 feet from the OHWL; <br /> c) A CUP pursuant to Orono Municipal Zoning Code Section 78-966 and 78-1286 to <br /> allow installation of rain gardens; <br /> d) An after-the-fact CUP to address the filling related to the as-constructed elevated <br /> patios within the 75-foot setback on the Property; <br /> Subject to the following conditions: <br /> 1. Council approval is based on the survey, construction and landscape plans submitted by <br /> the Owner and annotated by City staff, attached to this Resolution as Exhibits A, B & C <br /> Any amendments to the approved survey/site plan which are not in conformity with City <br /> codes will require further Planning Commission and City Council review. <br /> 2. Proposed hardcover levels are conforming to the Tier 1 standards and shall not increase <br /> above 4,019 square feet or 15.6% within the 0-75' zone and 6,072 square feet or <br /> 20.54% overall. Structural coverage limitations will also be met. No variances are <br /> granted for an increase of hardcover or structural coverage. <br /> 3. Authorities granted by this resolution run with the Property not with the Owner, but are <br /> permissive only and must be exercised by obtaining administrative building permits for <br /> the patios, paver walkway and rain gardens walls and commencing construction of said <br /> project within one year of the date of Council approval, or the variance and CUP will <br /> expire on that date (April 28, 2015). <br /> 4. Upon completion of the project and prior to release of escrow monies the Owner shall <br /> submit an as-built survey and as-built hardcover calculations verifying compliance with <br /> the approved plan. <br /> 5. Violation of or non-compliance with any of the terms and conditions of this resolution <br /> shall constitute a violation of the zoning code, shall automatically terminate any authority <br /> granted herein, and shall be punishable as a misdemeanor. <br /> Page 4 of 5 <br />
