� �� : <br /> O O <br /> - C ITY of ORONO <br /> ,� ;. � <br /> ti � <br /> ��� �p~' RESOLUTION OF THE CITY COUNCIL <br /> �kESII�4 NO. �� �i O <br /> A RESOLUTION <br /> GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTIONS 78-736 AND 78-1288 AND <br /> AN AMENDMENT TO RESOLUTION NO. 4674 <br /> FOR A CONDITIONAL USE PERMIT <br /> PURSUANT TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-734(11) <br /> FILE NO. 09-3405 <br /> WHEREAS, International Minesterial Fellowship, a Minnesota non- <br /> profit corporation, (hereinafter "Owner") is the owner of the property located at 2477 <br /> Shadywood Road within the City of Orono (hereinafter "City") and legally described as: <br /> Tract A and B, Registered Land Survey No. 88, files of the Registrar of Titles, Hennepin <br /> County, Minnesota(hereinafter "the Property"); and <br /> WHEREAS, Frank Masserano III has made application on behalf of the <br /> Owner to the City for a revision to the conditional use permit for a place of worship approved <br /> by Resolution No. 4674 for a place of worship to allow construction of a 22-foot by 45-foot <br /> entry deck; and <br /> WHEREAS, Frank Masserano III has made application on behalf of the <br /> Owner to the City for a Variance to Municipal Zoning Code Section 78-1288 to allow 44.25% <br /> hardcover within the 500'-1000' setback zone where 35% is normally allowed and 45.9% <br /> currently exists in order to construct a deck, rearrange portions of the existing drive and <br /> parking lot, and construct an entrance addition; and <br /> WHEREAS, Frank Masserano III has made application on behalf of the <br /> Owner to the City for a Variance to Municipal Zoning Code Section 78-734(11) to allow this <br /> deck to be constructed 30 feet from the property line when a 50 foot setback is required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on October 19, 2009, at which times all persons desiring to <br /> be heard concerning this application were given the opportunity to speak thereon. <br /> Page 1 of 5 � <br />
