The CiTy Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect tr�c conditions, light, air <br /> nor pose a fire hazazd or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owner but necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the Owner; and would be in keeping with the spirit and intent <br /> of the Zoning Code and Comprehensive Plan of the City. The City Council <br /> also finds that the change to the site plan for the conditiona.l use permit is not <br /> inconsistent with Orono Code Section 78- 916(a). <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a variance to Orono <br /> Code Section 78-1435 to allow construction of an accessory building, for storage of trash and <br /> recycling containers only, closer to the front lot line than the principal structure, grants a <br /> variance to Orono Code Section 78-736(e) to allow the accessory structure a seven-foot <br /> setback from the southeasterly property line when a 15-foot setback is required, and approves <br /> a revision to the site plan and building plans attached to Resolution No. 5880 to add the <br /> accessory building as shown on the attached Exhibit A to Exhibit A of Resolution No. 5880 <br /> and to add the building plans attached as Exhibit B to Exhibit B of Resolution No. 5880. <br /> Resolution No. 5880 otherwise remains in effect. <br /> 1. Authorities granted by this resolution run with the Property not with the owner, <br /> but are permissive only and must be exercised by obtaining a building permit <br /> for the new construction before June 28, 2011 or the approvals will expire on <br /> that date. <br /> 2. The variances remain in effect, even if the conditional use permit for a church <br /> lapses, until the principal building is replaced by a different building or until <br /> the principal building or this accessory building is removed and not replaced <br /> within 6 months of removal. <br /> Page 3 of 4 <br />
