Turner
Subject: RE: question
Amir
The City Code has two separate classifications of restaurants:
Restaurants (class IJ means a restaurant in which food is served to the customer and consumed by him while seated at a
counter or table, and the restaurant does not serve intoxicating liquor or provide live entertainment. Food is selected by
a customer while going through a serving line and taken to a table for consumption.
Restaurants(c/ass 11) means fast food convenience, drive-in and liquor service restaurants; a restaurant where a majority
of customers order and are served their food at a counter in packages prepared to leave the premises, or to be taken to
a table, counter, automobile or off the premises to be consumed; or a drive-in where most customers consume their
food in an automobile regardless of how it is served; or restaurants which serve intoxicating liquor or have live
entertainment.
In order to sell any alcoholic beverages you would need a conditional use permit for a Class II Restaurant. You should set
up a meeting with city staff to discuss the process for this type of application. I think there are a number of issues to
work through on a CUP—parking requirements, noise, outdoor tables, live music, hours, etc. The Code requires parking
provisions as follows: 78-1516(16) Restaurants, cafes, bars, taverns, nightclubs, at least one for each 80 square feet of
public floor area.
If you are interested in making an application please let me know.
Melanie Curtis
Planning & Zoning Coordinator
City of Orono
2750 Kelley Parkway
Orono, MN 55356
Direct Dial: 952.249.4627
Fax: 952.249.4616
Planning &2oning Office 952.249.4620
Email: mcurtisCaci.orono.mn.us
Website: www.ci.orono.mn.us
From: Aladdin [mailto:mail@aladdimm.com]
Sent: Friday, February 26, 2010 10:55 AM
i
