LA18-000071 <br /> WHEREAS, on August 29, 2018, , Dan Mulrennan o/b/o James Van Riemsdyk <br /> ("Applicant"), applied for a conditional use permit from the City Code for the property addressed 2655 <br /> North Shore Drive and legally described as: <br /> That part of Government Lot 4, Section 9, Township 117, Range 23, described as <br /> follows: Commencing at the North quarter corner of said section; thence on a bearing of <br /> South O degrees 00 minutes 00 seconds East (the North line of the Northeast Quarter of <br /> said section being assumed to have a bearing of South 88 degrees 51 minutes 00 seconds <br /> East for purposes of this description) a distance of 2878.55 feet; thence South 70 degrees <br /> 37 minutes 31 seconds East a distance of 838.42 feet to the point of beginning;thence South <br /> 67 degrees 19 minutes 23 seconds East a distance of 266.25 feet;thence South 32 degrees <br /> 16 minutes 30 seconds West a distance of 380 feet, more or less, to the shore of Lake <br /> Minnetonka; thence westerly along said shore to its intersection with a line drawn on a <br /> bearing of South 23 degrees 15 minutes 29 seconds West from the point of beginning;thence <br /> North 23 degrees 15 minutes 29 seconds East a distance of 393 feet, more or less, to the <br /> point of beginning. (hereinafter the"Property"); <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> conditional use permit to Orono Municipal Zoning Code Section 78-967 to allow to allow <br /> approximately 2,100 cubic yards to be cut from the site and approximately 1,700 cubic yards of <br /> fill material into the property; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> conditional use permit to Orono Municipal Zoning Code Section 78-967 to allow for the creation <br /> of the new engineered grade for the property; and <br /> WHEREAS, on September 17, 2018, after published and mailed notice in <br /> accordance with Minnesota Statutes and the City Code,the Planning Commission opened a public <br /> hearing, at which time all persons desiring to be heard concerning this application were given the <br /> opportunity to speak thereon; and <br /> WHEREAS, on September 17, 2018, the Planning Commission recommended <br /> approval of the conditional use permit; and <br /> 1 <br />
