The neighbors to the east all face the lake, yet front on Crystal Bay <br /> Road. The Property is relatively unique in this neighborhood. <br /> k. The Owner has indicated that granting of the variance is necessary for the <br /> preservation and enjoyment of a substantial property right of the Owner. <br /> I. The granting of the proposed variance will not in any way impair health, safety, <br /> comfort or morals, or in any other respect be contrary to the intent of this <br /> chapter. <br /> m. The granting of the requested variance will not merely serve as a convenience <br /> to the Owner, but is necessary to alleviate demonstrable difficulty. The Owner <br /> has indicated that the need for a storm shelter and additional storage on the <br /> Property serve as a practical difficulty. <br /> 4. The Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments by <br /> the Owner and the public, and the effect of the proposed variance and conditional <br /> use permit on the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this Property are peculiar to <br /> it and do not apply generally to other property in this zoning distri�t; that granting <br /> the variance and conditional use permit would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other danger to neighboring property; <br /> and would be in keeping with the spirit and intent of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council grants a variance <br /> from Orono City Code Section 78-1685 to allow construction of a 298 square foot detached garage <br /> resulting in 16.9% structural coverage, 242 square feet over the allowed 15% structural coverage <br /> level; subject to the following conditions: <br /> 1. Council approval is based on the survey and plans submitted by the Owner and annotated <br /> by City staff, attached to this Resolution as Exhibits A & B. Any amendments to the <br /> approved plans which are not in conformity with City codes will require further Planning <br /> Commission and City Council review. <br /> 2. The structural coverage level shall not exceed 16.9% or 2,071 square feet; overall <br /> hardcover levels shall not exceed the allowed Tier 1 levet of 25%. <br /> Page 3 of 5 <br />
