, <br /> _, , - <br /> �. . <br /> �-0�VO <br /> C ITY OF ORONO <br /> RESOLUTION OF T'HE CITY COUNCIL <br /> �`��., �.�'~ No. b5C� �J <br /> KESH�� <br /> A RESOLUTION <br /> GRANTING A VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1685 <br /> FILE NO. 15-3787 <br /> WHEREAS, David Wipson and Lisa Wipson, a married coupte (hereinafter"the <br /> Owner") are the owners of the property located at 2264 Shadywood Road within the City of <br /> Orono (hereinafter the "City") and legally described as: Lot 5, Block 1, "Wiley's Park" Lake <br /> Minnetonka, Hennepin County, Minnesota (hereinafter the "Property"); and <br /> WHEREAS, the Owner has made application to the City of Orono for a variance <br /> from Orono City Code Section 78-1685 to allow constructionof a 298 square foot detached garage <br /> resulting in 16.9% structural coverage, 242 square feet over the allowed 15% structural coverage <br /> level; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code,a public hearing was held by the Orono <br /> Planning Commission on October 19, 2015 at which time all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File number 15-3787. <br /> 2. The P�operty is located in the LR-1 C One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 0.5 acres and a minimum lot width of <br /> 100'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> October 19, 2015 and voted 4 for and 0 against on a motion to approve the <br /> variance. The Planning Commission finds that the following factors support the <br /> granting of the request: <br /> a. The Property has 12,197 square feet or 0.28 acres in area and 41 feet in width <br /> at the OHWL and 45 feet at the 75-foot setback. <br /> Page 1 of 5 <br />
