Henry, III, a single person, (hereinafter "Owner") is <br /> the owner of the property located at 2216 Shadywood Road within the City of Orono <br /> (hereinaf�er "City") and legally described as: Lot 11 Block 1 Wileys Park Lake Minnetonka <br /> Heruiepin County, Minnesota(hereinafter "the Property"); and � <br /> WHEREAS, Vogue I.C.F. Homes (hereinafter "Applicant") has made <br /> application on behalf of the Owner to the City for a variance to Municipal Zoning Code <br /> Section 78-350 to allow coilstruction of a replacement residence on a lot that is 0.39 acre in <br /> • area when 0.5 acre is required and is 51 feet in width when 100 feet is required; and <br /> WHEREAS, Vogue I.C.F. Homes has made application on behalf of the <br /> Owner to the City for a variance to Municipal Zoning Code Section 78-1288 to allow <br /> construction of a replaceinent residence oii the Property with 27.7 percent hardcover in the 75 <br /> to 250 foot zone when 25 percent is allowed; and <br /> WHEREAS, after due published notice and mailed notice in accordarice with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Coirunission held a public hearing on NovemUer 20, 2006, at which times all persons desiring <br /> to be heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVEI) by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS . <br /> 1. This application was reviewed as Zoning,File#06-3239. <br /> 2. The property is located in the LR-1 C zoning district, where 0.5 acre acre is the <br /> minimum lot area and 100 feet is the minimum lot width. The property is <br /> approximately 0.39 acres in area and 51 feet in width. <br /> ! 3. The Planning Commission reviewed this application on November 20, 2006 <br /> Page 1 of 5 <br />
