Mr. Greg Erickson <br /> August 3, 1994 . <br /> Page 2 <br /> The Lake Minnetonka Conservation District(LMCD) also regulates docks on Lake Minnetonka. <br /> "Private bathing and private boating" is not specifically defined in the easement document. The <br /> City does not generally provide a dock on City-owned access lots for boating purposes. It is the <br /> City's position that "private boating" does not in this instance include the right of easement <br /> holders to construct docks. <br /> Similarly, no individual docks are allowed wit,hin the adjacent 66' right-of-way leading from <br /> County Road 19 to the shoreline (see plat map). This 66' has been opened as a winter lake <br /> access but is not open to boat launching. <br /> The four easement lots are directly across Crystal Bay Road from the residential properties at <br /> 3407-3415-3435-3545 Crystal Bay Road. Some of the owners of these residential properties may <br /> have constructed docks on the easement lots without City comment. The City has not issued <br /> permits for those docks. Whether those docks are "legal" has not been determined. <br /> To reiterate, the City's position is that while a significant number of Navarre area property <br /> owners may have in their deeds a purported right to use the lakeshore portion of Lots 1 through <br /> 4 for private bathing and private boating purposes only", that right certainly does not include <br /> the right to construct a dock. We have not researched whether, for instance, it gives them the <br /> right to launch boats or canoes, swim, sunbathe, etc. at this location. Certainly, the lack of <br /> parking and the narrowness of the land portion lakeward of the road limits the degree of actual <br /> use that could be made of the property. <br /> Again, I hope the above information is of some help to you.
