Per the Wetland Conservation Act Rules Chapter 8420, wetland fill <br /> is defined as- <br /> Subp. 26. Fill. "Fill" means any solid materi�l added to or redeposited in a wetland that would alter the <br /> wetland's cross-section or hydrological chanacteristics, obstruct flow pattems, change the wetland <br /> boundary, or convert the wetland to a nonw tland. Fill does not include posts and pilings for linear projects <br /> such as bridges, elevated walkways, or po�erline structures, or structures traditionally buiit on pilings such <br /> as docks and boathouses. Fill includes posts and pilings that result in bringing the wetland into a <br /> nonaquatic use or significantly altering the�+etland's function and value, such as the construction of office <br /> and industrial developments, parking struct�res, restaurants, stores, hotels, housing projects, and similar <br /> structures. Fill does not include slash or woody vegetation, if the slash or woody vegetation originated from <br /> vegetation growing in the wetland and does Inot impair the flow or circulation of water or the reach of the <br /> wetland. <br /> In summary, as long as you are not proposirng to bring in fill that would cause the wetland to become <br /> upiand, installing a dock would be fine withi�i WCA regulation. Please note that the wetland onsite is a <br /> DNR public waters and the DNR regulates docks and aquatic vegetation removal. Attached is the DNR <br /> dock guidance requirements. If you are proposing to exceed the dimensions in the guidance, you will need <br /> to apply for a permit through the DNR MPAf�S system. I have been advised that it is difficuft to justify <br /> exceeding the dimension guidance.
