. d . <br /> Sec.13.04 RIGIiTS OF S[lB.TECTS OF DATA <br /> Subd. 1. Type of data. The righcs of individual on whom the data is stored or to be stored shall be as set forth ia this secdon. <br /> Subd.2. Information reqirired to be given individual. An individual asked to supply private or confidendal dara concerning himself shall <br /> be informed of: (a)the purpose and intended use of the requested data within the collecting 3tate agency,political subdivision,or stauwide system; <br /> (b)whether he may refuse oY is legally required to supply[he requested data;(c)any lmown consequence arising from his supplying or refusing to supply <br /> private or confidenrial dare;and(d)the idenrity of other persons or enrides auchorized by state or federsi law to�eceive the dara. This requirement shall <br /> not apply when an individual is asked to supply invesdgadve data,pursuant to secdon 13.82, subdivision 5, to a law enforcement o�cer. <br /> The commissioner of re�enue mav place the nodce rewired under this subdivision in the individual income rax or prooem tax refund <br /> instructions instead of on those forms. <br /> Subd.3. Access to data by individual. Upon request to a responsible authority,an individual shall be informed wherher he is the subject <br /> of scored data on individuals,and whe[her it is class�ed as public, privace or confidential. Upon his further request,an individual who is the subject <br /> of stored private or public dara on individuals shall be shown rhe dara without any charge to him and,-if he desires, shall be informed of the content <br /> and mea�lih��of di�t dara. Afrer an individual has been shown che private data and informed of iu meaning,the data need not be disclosed to him for <br /> six monchs.thereafter unless a dispuu or action pursuanc w chis secdon is pending or addiuonal data on the individual has been collected or created. <br /> The responsible authority sha�(pcovide copies of the private or public data upon requesc by the individuai subject of the data. The responsible authoriry <br /> may�require the requesting person to•pay the acmal cosu of making,certifying:and compiling the copies. .. <br /> The responsible au[horiry sf�all comply immediately,if possible,with aay request made pursuant to this subdivision,or within five days of <br /> the date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with the request <br /> within that time,he shall so informa[he individual,and may have an addidonal five days within which to comply with the request,excluding Saturdays, <br /> Sundays and legal holidays. ' <br /> Subd.4. Procedure when data is not aceurate or complete. An individua[cn�y eontest the accuracy or completeness of public or private <br /> data concerning himself. To exercise this right,an individual shall notify in wri[ing the responsible authoriry describing che nature of ihe disagreement. <br /> The responsible authoriry shall within 30 days either: (a)correct the data found m be inaccuiate or ihcomplete and attempt to nodfy past recipients of <br /> inaccurate or incomplete data, including recipients named by the individual;or(b)notify the individual that he believes the data to be correct.
