J 8 L ( <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a variance to <br /> Orono Municipal Zoning Code Section 78-350(B) to allow construction of a new house on a lot <br /> with a width of 61 feet when a width of 100 feet is required and a variance to Section 78-1288 to <br /> allow 28.4% hardcover within the 75'-250' zone where 25% is normally allowed in conjunction <br /> with the construction of a new residence and detached garage, subject to the following <br /> conditions: <br /> 1. Council approval is based on the site plan, landscape plan and house renderings <br /> submitted by the Applicant and annotated by City staff, attached to this Resolution as <br /> Exhibits A, B and C. Any amendments to these plans that are not in conformity with <br /> City codes will require further Planning Commission and City Council review. <br /> 2. Hardcover in the 0-75' zone consists of an allowed lake access stair and 85 s.f. of <br /> boulders. Hardcover in the 75-250' zone shall be limited to 3,876 s.f. or 28.4% per the <br /> site plan as depicted on Exhibit A. Applicant is advised that any future requests to <br /> increase hardcover or change the nature of existing/approved hardcover shall require City <br /> approval, and increases in hardcover will not likely be approved without concurrent <br /> reduction in existing hardcover. <br /> 3. Applicant shall not place any plastic or fabric liner material under any landscaping on the <br /> property to ensure their permeability as non-hardcover surfaces. <br /> 4. Proposed removals of structure and hardcover to be removed shall be completed prior to <br /> a footing inspection for the proposed home. <br /> 5. The handrail for the patio staircase cannot exceed 42" in height within the average <br /> lakeshore setback. <br /> 6. SURVEYS REQUIRED: <br /> a. A foundation survey with setbacks and top of foundation elevations is required to <br /> be submitted prior to commencement of framing; and <br /> b. An as-built survey with topography and hardcover calculations verifying <br /> compliance with the building permit, stormwater management, grading and <br /> Page 3 of 4 <br />
