�3�d�f�.� <br /> R <br /> 9 <br /> • • t . <br /> . �O�O <br /> C ITY OF ORQNO <br /> RESOLUTION OF THE CITY COUNCIL <br /> y`�1., �.G`� N o. 6 5 2 9 <br /> kESH�� <br /> A RESOLUTION GRANTING <br /> SETBACK VARIANCES <br /> FROM ORONO MUNICIPAL CODE <br /> SECTIONS 78-350 �78-1279 <br /> FILE NO. 15-3750 <br /> WHEREAS, Jeff Von Feldt and Elaine Wyatt, a married couple, (Hereinafter <br /> the "Appiicants°) are the owners of the property located at 1990 Shadywood Road within the <br /> City of Orono (hereinafter "City") and legally described as: Lot 40, Shady-Wood, Hennepin <br /> County, Minnesota (hereinafter"the Property"); and <br /> WHEREAS, the Applicants have made application to the City for a variance <br /> from Orono City Code Section 78-350 to permit construction of a second story over the existing <br /> home as close as 7 feet from the north side properly line where a 10 foot setback is required; <br /> and , <br /> WHEREAS, the Applicants have made application to the City for a variance <br /> from Orono City Code Section 78-350 to�rmit construction of a second story over the existing <br /> home as close as 21 feet from the rear property line where a 30 foot setback is required; and <br /> WHEREAS, the Applicants have made application to the City for a variance <br /> from Orono �ity Code Section 78-1279 to permit construction of a second story over the <br /> existing home as close as 65 feet from the ordinary high water level (OHWL) of the lake where <br /> a 75 foot setbadc is required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held a public hearing on June 15, 2015, at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> 1. This application was reviewed as Zoning File#15-3750. <br /> 2. The Property is located in the LR-1 C One Family Lakeshore Residential Zoning District <br /> which requires a minimum lot area of 0.5 acres and a minimum lot width of 100'. <br /> 1. The Planning Commission reviewed this application on June 15, 2015, the Planning <br /> Commission voted 6 in favor and 0 opposed on a motion to: approve side, rear and <br /> Page 1 of 5 <br />
