Applicants shall remove all plastic or fabiic liner material from the decorative <br /> landscape beds on the property to ensure their permeability as non-hardcover <br /> swrfaces. <br /> 4. Required removals of hardcover shall be completed by the footing inspection for <br /> the detached garage. <br /> 5. Applicants are advised that the City Council intends that the level of structural <br /> coverage approved via this variance is the maximum that should be approved for <br /> this property, and future requests for additional structural coverage are not likely <br /> to be approved. <br /> 6. The applicants must provide and City staff must approve of a landscape plan <br /> • which will provide screening of the detached garage from the channel prior to the <br /> issuance of a building permit for the detached gaxage. The approved landscape <br /> plan must be implemented prior to a final inspection of the detached garage. <br /> 7. Authorities granted by this resolution run with the property not with the <br /> applicants, but are permissive only and must be exercised by obtaining a building <br /> permit for the new construction within one year of the date of Council approval, <br /> or the variance will expire on that date (May 23, 2006). <br /> 8. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> 9. The undersigned applicants have read, understand and hereby agree to the terms <br /> of this resolution and on behalf of the applicants and the applicants' heirs, <br /> successors and assigns, hereby agree to the recording of this resolution in the <br /> chain of title of the property. � <br /> • . <br /> Page 4 of 6 <br />
