The original residence structure was constructed in the early SOs prior to <br /> the current lakeshore development standards. <br /> B. The irregular or curved shoreline at this properry results in an inewlar <br /> lakeshore setback line. <br /> C. As the grade level lakeside deck is located completely in front of the <br /> residence, the deck will-have no impact on the lakeshore views of the <br /> residences on either side of this property. <br /> D. The City has received no negative comments from the neighbors on the <br /> adjacent properties. <br /> E. The proposed improvement will result in a decrease of 175 s.f. of <br /> hardcover unprovements within the 0-75' setback area. <br /> • <br /> � 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> right of the applicant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> r�commendations of the Planning Commission, reports by Cit�� staff, comments <br /> by the applicants and the�effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> Qrants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 (A), 1 (B) and 2 to <br /> permit the reconstruction of a 14'x26' deck granting an average lakeshore setback for the entire <br /> structure, a 4' or 5.3% lakeshore setback variance and hardcover variances within the 0-75' <br /> setback area at 52 s.f. or 0.40% and 1,095.3 s.f. or 4% in the 75-250' setback area, subject <br /> • to the following conditions: <br /> Page 2 of 5 <br /> ' Fam5005 DiskOram <br />
