,- ;� <br /> � O� • ' <br /> • O �, O <br /> 3 C ITY of ORONO <br /> � --- : - � <br /> , ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> �L`9k'ESi3�g'�G NO. � � a � <br /> denial of the hardcover variances; recommending that the 1993 hardcover variances <br /> granted by Resolution No. 3236 be upheld; and <br /> WHEREAS, the applicants were directed to provide a revised site plan meeting <br /> th recommendation of the Planning Commission, and applicants have not provided such a <br /> plan nor responded to City requests for same; and <br /> WHEREAS, the City Cotuicil has reviewed the application; the recommendation <br /> of the City staff and Planning Commission; and the comments and written statements <br /> submitted by the applicants. � <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, <br /> Minnesota hereby denies the requested variances as described above based on one or <br /> � more of the following findings of fact conceming this property: <br /> l. Variances were granted in 1993 (Resolution Number 3236) on this , <br /> property to permit hardcover variances within the 75' —250' zone of 6,189 <br /> s.f. (25.9%) and within the 250' — 500' zone of 1,665 s.f. (31.4%) where <br /> 25% and 30%respectively are allowed. <br /> 2. It is the intent of the Comprehensive Plan and Zoning Code to protect the <br /> water quality of Lake Minnetonka by limiting the amount of hardcover a <br /> lot contains. No hardship exists on this lot that would allow additional <br /> hardcover. <br /> 3. The granting of the requested variances would be contrary to the <br /> provisions of Municipal Zoning Code Section 78-123 with which the <br /> applicants must first comply in order that variance be granted. The <br /> Council finds that: � <br /> � a. The property in question can be put to a reasonable use if used under <br /> the conditions allowed by the official controls. <br /> b. With regard to the hardcover, the plight of the landowner was created <br /> by the landowner. <br /> •' c. Granting of the proposed variances would appear to serve as a <br /> convenience to the applicants and the applicants have not <br /> Page 2 of 4 <br />
