The property has been assessed for City water and was assessed a separate water unit. 10. The lot area of 15 ,100 square feet is consistent with many other properties in the neighborhood and is equivalent to or larger than 11 of 25 existing building sites in the neighborhood. 11. The lot width of 60 feet is equivalent to or larger than 10 of 25 existing lots in the neighborhood. 12 . The City Council has considered this application including the findings and recommendations of the Planning � Commission, reports by City staff, comments by the aplicant and the effect of the proposed variance on the health, safety and welfare of the community. 13 . The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light , air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above f indings, the Orono City Counci 1 hereby grants a variance to Municipal Code Section 10.25, Subdivision 6 (B) to permit the construction of a residence on a property with 15,100 square feet in area instead of the required 21,780 square feet, and approve a lot width of 60 feet instead of the required 100 foot lot width, subject to the following conditions : l. Maximum hardcover of Lot 21 is to be 2,280 square feet including roofs, decks, driveways, sidewalks , patios , terraces , and the like. page 2 of 3
