NO. <br /> �kESHO� <br /> A RESOLUTION GRANTING <br /> MASTER DEVELOPMENT PLAN APPROVAL <br /> AND GRANTING A CONDITIONAL USE PERMIT <br /> AND FINAL PLAT OF STONEBAY EIGHTH ADDITION; <br /> PLANNED DEVELOPMENT NO. 16 <br /> FILE NO. LA18-000034 <br /> WHEREAS, the City of Orono (hereinafter the "City") is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; and <br /> WHEREAS, the City Council of the City of Orono (hereinafter"City Council") has <br /> adopted land development regulations for the orderly, economic and safe development of land <br /> within the City; and <br /> WHEREAS, Apex Holdings, LLC, a Minnesota limited liability company <br /> (hereinafter the "Developer") is owner of the property located at 2635 Kelley Parkway within the <br /> City of Orono (hereinafter the "City") and legally described as follows: <br /> Outlot D, Stonebay Addition (hereinafter the "Property"); and <br /> WHEREAS, on August 28th 2017, the City Council adopted Resolution No. 6786 <br /> granting General Concept Plan, CUP for an assisted living facility use, Preliminary Plat, <br /> Community Management Plan Amendment, and Zone Change Approvals for the proposed <br /> development, which includes the following elements: <br /> 1. Rezoning of the Property from RR-1 B PUD Single Family Rural Residential Planned Unit <br /> Residential District to RPUD Residential Planned Unit Development District; <br /> 2. Construction of a single, two-story, 72-unit senior assisted living facility. <br /> WHEREAS, in October 2017, the Metropolitan Council also granted approval of <br /> the 2008-2030 Orono CMP amendment; and <br /> WHEREAS, on March 20, 2018, the Developer filed a formal application with the <br /> City for rezoning, Master Development Plan, and final plat approval for a 72 unit senior care facility <br /> on the Property; and <br /> WHEREAS, City staff and consultants have reviewed the final plans for this and <br /> hereby approve each and identify them as part of the official record for PUD No. 16. <br /> WHEREAS, the Developer has completed or has agreed to complete all other <br /> Page 1 <br />
