� � <br /> � O ' V <br /> O O <br /> �e:_- c ITY of URONo <br /> � � � � <br /> � G RESOLUTION OF THE CITY COUNCIL <br /> �9 4�' N 0: 1� .� '�= �' <br /> kESH� <br /> A RESOLUTION DENYING <br /> VARIANCES PER <br /> MUNICIPAL ZONING CODE ' <br /> SECTION 10.22, SUBDIVISION 1 (A)AND (B); <br /> SECTION 10.22, SUBDIVISION 2; <br /> SECTION 10.56, SUBDIYISION 16 (L) (1); <br /> AND SECTION 10.56, SUBDIVISION 16 (C) (6). <br /> FILE #2453 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS,pursuant to State Statutes 412 et. seq. and 462 et. seq., the City Council <br /> of the City of Orono has adopted zoning regulations for the protection of the public health, safety <br /> and general welfare; and <br /> WHEREAS, John Ericson, Sr. (hereinafter "the applicant") is the owner of the <br /> property located at 1620 Shadywood Road within the City of Orono (hereinafter "the City") and <br /> legally described as follows: <br /> Lot 3, Lot 4, and the South 5.00 feet of Lot 2, Shadywood, Hennepin County, Minnesota <br /> (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City of Orono for variances to the <br /> Zoning Code to pernut construction of a 12'by 20' pagoda(boathouse) 20' from the 929.4' Ordinary <br /> High Water Level (OHWL) of Lake Minnetonka, a General Development Lake, requesting the <br /> following approvals: <br /> 1. Section 10.22, Subdivision 1 (A) and (B) to permit structure within 75' of the lakeshore and <br /> within the Average Lakeshore Setback of adjacent residences where no structure is normally <br /> allowed. <br /> 2. Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (1) to permit 878 s.f. <br /> (7.8%) of hardcover in the 0-75' lakeshore setback where 710 s.f. (6.3%) exists and none is <br /> allowed. However, all existing hardcover within 75' of the lake is legal as it has e�sted for <br /> many years, or is permitted as a walkway to the lake. <br /> Page 1 of 3 <br />
