3. In no case shall any fence bordering upon any street or sidewalk be <br />constructed to a height which could obstruct the clear vision of drivers or <br />pedestrians entering or within the public right of way or at intersections. <br />Subd. 2 - Single Family Residential Fence Standards <br />a. Location. <br />1. No fence or wall shall be located closer than five (5) feet to the paved edge of <br />a street. <br />2. No fence or wall shall be located closer than ten (10) feet to the Ordinary High <br />Water Level of a lake. <br />b. Height. The height of fences or walls shall be measured from the ground level to the <br />top of the fence or wall. Fence height shall be restricted according to the location as <br />follows <br />1. Riparian Lots. <br />a) Front yard: Fences in the front (lakeside) yard between the shoreline <br />and the greater of the building line of the house or fifty (50) feet, shall <br />be no more than three (3) feet in height. Fences or walls located within <br />the buildable area of the lot and at least fifty (50) feet from the shoreline <br />may be up to six (6) feet in height. <br />b) Side yards: six (6) feet maximum. <br />C) Rear yard: four (4) feet maximum. For riparian lots whose rear yards <br />face County Road 19 (Manitou Road) rear yard fences may be <br />constructed to a maximum of six (6) feet. <br />d) Visually -Impairing Elements (VIE), <br />1. No person shall cause to exist, or shall maintain, any Visually - <br />Impairing Element which includes: <br />a. An area consisting of five feet from a property line and within 50 <br />feet of the ordinary high water level or <br />b. The average setback of the two adjacent riparian principal <br />structures on either side of a parcel. <br />2. All property owners within the City shall be required to, within these <br />areas, maintain all privately -planted vegetation. VIE shall be <br />restricted according to the location as follows: <br />a) Front yard: VIE in the front (lakeside) yard between the shoreline <br />and the greater of the building line of the house or fifty (50) feet, <br />shall be no more than three (3) feet in height. VIE located within <br />the buildable area of the lot and at least fifty (50) feet from the <br />shoreline may be up to six (6) feet in height. <br />b) Side yards: six (6) feet maximum. <br />c) Rear yard: four (4) feet maximum. For riparian lots whose rear <br />yards face County Road 19 (Manitou Road) rear yard VIE may be <br />constructed to a maximum of six (6) feet. <br />3. Failure to comply with this section shall constitute a public nuisance <br />pursuant to Tonka Bay City Code Section 1130 and Minn. Statute <br />609.74. <br />2. Non -Riparian Lots. <br />a) Front yard: four (4) feet. <br />b) Side yards: six (6) feet <br />
