FILE #LA18-000040 <br />21 May 2018 <br />Page 4 of 4 <br />observed, but nothing in this section shall prevent the city from enacting or amending official <br />controls to change the status of conditional uses. <br />Conditional Use Permit Analysis <br />The applicant is proposing to change the nature of the property to support a new home. The <br />proposed housing style is more in keeping with the immediate neighborhood. To accomplish the <br />desired home (and the tuck under garage), the grade must be adjusted with fill in the area <br />between the house and the road on the northeast side. The proposed home will have a first floor <br />garage elevated above the current grades by approximately 7 feet; the lower level garage floor <br />will be set within a foot or so of the existing grade. <br />Engineer Comments <br />The City Engineer's comments are attached as Exhibit F. <br />Public Comments <br />To date, no public comments have been received. <br />Issues for Consideration <br />1. Does the Planning Commission find that that the property owner proposes to use the <br />property in a reasonable manner which is not permitted by an official control? <br />2. Does the Planning Commission find that the CUP, if granted, will not alter the <br />essential character of the neighborhood? <br />3. Does the Commission find it necessary to impose additional conditions in order to <br />mitigate the impacts created by the granting of the requested CUP? <br />4. Are there any other issues or concerns with this application? <br />Planning Staff Recommendation <br />Planning Staff recommends approval of the conditional use permit with the following conditions: <br />1. City engineer and watershed district shall approve the erosion control plan. <br />2. The street swept daily, or as needed, to keep debris off of Smith Avenue. <br />3. The applicant must conform to the City's and MCWD's erosion control regulations. <br />4. Only clean fill to be imported to the site. <br />5. Conformance with the City Engineer's requirements at the time of the building permit. <br />6. Hauling shall occur during allowed construction hours only Monday through Friday 7 am <br />to 8 pm (and between 8 am and 8 pm on weekends and holidays). <br />7.
