Sec.13.04 RIGHTSOFSUBJECTSOFDATA - � Subdivision 1. Type of data. The rights of individual on whom the data is stored or to be stored sha11 be as set forth in this secliox. Subd.2. Information required to be given individuaL An individual asked to supply private or confidentia!data concerning himse f shall be informed of (aJ the purpose and intended use of the requested data within the collecting slate agency,political subdivrsion,or statewide system;(b)whether he may refuse or is[egally required to supply the requested data;(c)any known consequence arising from hrs supplying or refusing to supplyprivate or confidential data;and(d)the identity of otherpersons or entities authorized bystate orfedera[!aw to receive the data. 77ris requirement shall not apply ivhen an individual is asked to supply imestigative data,pursuant to section 13.82, subdivision S, to a law enforcemen!o�cer. 7Tre commrssioner of revenue mav place!he notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those torms. Subd.3.Access to data by individuaL Upon request to a responsible authority,an individual sha/l be rnformed whether he is the subject of stored data on indivrduals,and whether it is classifted as public,private or confrdentiaL Upon his further request,an individual who is the subjec!of stored private or public data on indivrduals shall be shown the data without arry charge to him and,if he desires,sha[l be informed oJ the conlent and meaning of thal data. After an indivrdual has been shown the private data and informed of its meaning,the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the rndivrdua!has been collected or created. The responsible authority sha[l provide copies of the private or public data upon request by the indivrdual subject of the data. The responsible authority may require the requestrng person to pay the actual costs of making,cert�ing,and compiling the copres. The responsible authoriry shal!comply immediately,ifpossible,with arry request made pursuant to this subdrvision,or within frve days of the date of the request,excluding Saturdays,Sundays and lega/holidays,if immediate cornpliance rs not possrble. Ifhe cannot comply with the request within that time,he sha(1 so inform the rndividual,and may have an addrtional five days tivithin which to comply with the request,excluding Saturdays,Sundays and lega!holidays. Subd.4. Procedure when data is not accurate or complete An individual may contest the accuracy or completeness ofpublic or prrvate data concerning himse[f. To exercise this right, an individual shall not�in writing the responsible authority describing the nature of the disagreement The responsible authority shal[within 30 dcrys either: (a)correct the datafound to be inaccurate or incomplete and attempt to not� past recipients of inaccurate or incomplete data,including recipients named by the rndividual;or(b)notify the individual that he believes the data to be correct. Data in drspute shall be disclosed only if the individual's statement of disagreement is inc[uded with the disclosed data. The determination of the responsible authority may be appealed pursuant to the provrsions o.f'the administrative procedure act relatrng to contested cases.
