' <br /> Clean Water Act Section 402 <br /> Under Section 402(P) of the Clean Water Act,the U.S. Environmental Protection <br /> Agency is required to develop regulations for stormwater di:ccharges. The <br /> Minnesota Pollution Control Agency (MPCA)has the authority to regulate the <br /> stormwater program under the National Pollution Discharge Elimination System <br /> (NPDES)program. The MPCA has written a general permit for construction sites, <br /> which grade more than 1 acre. As of July 1, 2003, a permit application and fee of <br /> $400 (no plans or specifications)must be sent to the MPCA at least 48 hours prior <br /> to commencement of land disturbance activities. The permit application required <br /> the site owner and contractor to certify the provision of the general permit, <br /> including developing and implementing temporary and permanent erosion and <br /> sediment control plans,will be followed. The general permit requires that <br /> stormwater dischazges be preponded before dischazge to waters of the state <br /> (including wetlands). The general permit also requires inspection and <br /> maintenance of the erosion and sediment control facilities on a weekly basis.
