Sec. 78-1601 of Orono's Wetland Protection Ordinance, the proposed construction on the <br /> above listed property triggers the city's ordinance due to the following: <br /> • Disturbed property drains towards the wetland. <br /> • �rading exceeds 50 cubic yards. <br /> • Net increase in the square footage of impervious surface area. <br /> The wetlands found on this property have both been classified as Manage 3 wetlands, which require a <br /> buffer width of 16.5 feet. <br /> The following is a summary of the issues that exist with the current plan submitted to the City, and <br /> the requirements per the Wetland Protection Ordinance to be in compliance: <br /> 1. According to the current grading plan, the patio surrounding the pool is located in the setback. City <br /> ordinance states that all principle and accessory buildings must be set back a minimum of 20 feet <br /> from the wetland buffer(Div. 5 Sec. 78-1608 (2)). Patio slabs and grade-level decks are exempt <br /> from this rule which suggests the pool area may still be in compliance with the city's ordinance. <br /> 2.
