Christine Mattson
From: Smyth, John R [John.Smyth@bonestroo.com]
Sent: Friday, February 11, 2011 1:07 PM
To: Christine Mattson
Cc: Melanie Curtis; Tom Kellogg
Subject: RE: 2180 Abingdon Way/ Building Permit#P11213 or 2007-11213
Attachments: Survey.pdf; 06-056-48_Upland Buffer Management Plan_2180 Abington Way.pdf
Christine,
I have verified that as you noted there is restrictions and covenants recorded with the County over a 35 foot buffer
provided to the MCWD in 2002 when the DeVries owned the property. The pool and addition project permitted in 2007
was under the City Wetland Code which requires a 50 foot buffer. Both these are shown on the attached Survey
completed for the Gages by Gronberg. I think we need to check with Melanie and see how she would like to handle this
one. Should we get the an easement over the additional 15 feet required by the City?
In regards to the escrow agreement and inspection of the buffer—They provided a plan they were to follow that gave
them three years to get buckthorn and garlic mustard under control so it is time to see how things turned out (attached
for your record). I will contact Britt Gage this spring and indicate we would like to review the buffer so we can determine
if they are in compliance with their approved plan. It will be added to the list for this spring.
John
7ohn Smyth
Associate
Direct 651-604-4708
Cel I 651-775-5104
john.smyth@bonestroo.com
 Bonestrto
Vsit tl,e new Bonestroo.com to sign-up for SourceONE,
our upcoming newsletter.
From: Christine Mattson [mailto:CMattson@ci.orono.mn.us]
Sent: Tuesday, February 08, 2011 12:00 PM
To: Smyth, John R
Cc: Kellogg, Tom P; Amundsen, Darren T; Melanie Curtis
Subject: 2180 Abingdon Way/ Building Permit #P11213 or 2007-11213
John,
The permit noted above is for a pool and pool house which disturbed the buffer for the wetland on the
property.
We have a signed escrow agreement, but I don't see any notes that you've inspected the site.
I do not have a signed wetland buffer easement from Richard and Britt Gage (the owners at the time the
permit was pulled), but there is one in the file for previous owners Timothy and Gayle DeVries.
Please let me know what your notes indicate and our next step.
Thanks!
i
