City Staff performed an inspection that <br /> afternoon and a Stop Work order was issued as City approvals are required for such activity. The <br /> following activities were observed: unpermitted filling and grading; construction and/or grading work in <br /> a wetland area; installation of a hard cover pond liner; and rock materials brought onto the site in and <br /> adjacent to the wetland. In addition, we have no record permits approved for this project by the City of <br /> Orono or the Minnehaha Creek Watershed District (MCWD). Your caretaker Dale Hoikk was notified of <br /> this requirement to Stop Work both verbally and in writing based upon the enclosed Inspection Notice. <br /> Mr. Hoikk accompanied me for an on-site inspection of the work underway; the attached photos were <br /> taken during the staff inspection to further document the work activity. <br /> This work from initial review appears to be in violation of City Code Sections 78-966, 78-967, 78-1605 <br /> and 78-1608 through 1610(enclosed)which requires prior City approval and permits for such work. <br /> Until further resolution of this matter, the work remains in violation of the above referenced City Codes <br /> and no further work may be conducted until this rraatter is resolved. In order to begin to bring the <br /> property into compliance you must comptete or provide the following: <br /> 1. Complete the enclosed zoning permit application; after the fact fees will apply. This permit will <br /> cover disturbances/filling/grading activities outside the wetland boundary in an amount up to <br /> 500 cubic yards. *Please note: if the work on site is within the wetland and/or exceeds 500 <br /> cubic yards a City Council review for a conditional use permit will be required. <br /> 2. Provide an escrow for erosion control (see the attached escrow agreement) and provide an <br /> escrow in the amount of$2000. <br /> 3. A MCWD Notice of Decision reflecting a MCWD-approved wetland delineation. The wetland <br /> delineation must be conducted within the growing season therefore should be done soon. <br /> 4. The wetland boundary and all property lines must be staked on site. <br /> 5. Silt fencing and erosion control measures must be established per the MCWD's guidelines. <br /> 6. A revised certificate of survey for the property meeting the City's standards (enclosed) and <br /> specifically showing the following: <br />
