H'oehn indicated he is willing to dc, buckChorn mitigation and other t}iings to help offset that. <br /> McMiiian stated from her point of view,w�atever plan that is woriced �ut with the Watershed District is <br /> fine, but that she had thought the Council would be seeing a final plan from the Watershed District <br /> tonight. McMillan indicated she would like to see that if the City goes ahead with an encmachment <br /> agreement. <br /> Mr. FIaehn asked if the easement area bel�ind the house coulci be designated to take the place of ar�y area <br /> that is impacted currently. Hoehn pointed out the easement on the overhead. <br /> Mc1Vlillan stated ta her understanding ttiaC is not part of their property and that it wauld be difficult to use <br /> that. <br /> tiaffran stated the sewer easement goes frc�m v��est ta east behind the property. <br /> McMillann statec� sametimes ihe Watershed Disirict will agree to move fhe��etland huffer but that she <br /> cannot speak for them. McMillan suggested they speak with the Watershed District and come up with a <br /> formal plan. <br /> Waish staied lit�would npt be apposed ta having the motic�n state subject to. <br /> Levan�stated she wouid like to see the plan so every�ne understands what is goin�ta happen since the <br /> City does need to sign off on the encroachment agreement. <br /> Printup moved to direct Staff ta draft an encroachment agreement allowi�g the entire retaining <br /> wall subject to complianc�e�vi#b the regu(ations the Minnehaha Creek Watershed District would <br /> require for establishment of the native vegetatio�, <br /> Mattick stated tlle encroaclunent agreernent would come back to the City C�unci.l at approximately the <br /> same tiilze that rhe plan vv�ith the MCVVD is �nalized. <br /> Walsh seconded tl�e motion. <br /> VtTalsh stated he does not wanl to penalize the Hoehn's�•ith after-the-fact pennit fees due to the unkno��n <br /> origin of the permits.
