<br /> THIS INDENTURE,made this,L da,y of August, 2006,b.y and between Calvin
<br /> Presbyterian Church of Orono, a Minnesota nonprofit corporation, hereinafter referr�d to as _
<br /> "Grantor",and the City of Orono, a municipal corporation,hereinafter referred to as "Grrrantee".
<br /> WITNESS, that Grantor, in consideration of the sum of One Dollar ($1.00) and �
<br /> other good and valuable considera#ion given by Crrantee, the receipt of which is acknowleciged by
<br /> Gnraator, does hereby grant, bargain, sell and convey to Grantee, its successors and assigns, a
<br /> �- perpetual easement for public ingress, egress, and access for pedestrian trail purposes and uses, � .
<br /> including the right to constivct and maintain the same, to�ether with the right af th� public for
<br /> access over, above, under and across the land locaxed in the State af Minnesota, County of �
<br /> Hennepin,legally described as follows:

<br /> including, but not by way of limitation, a full and free right and authority to enter upoa said land
<br /> to constrvct, install, maintain, operate and repair a gravel or paved trail and any and all
<br /> �ppurtenances, incidental and related thereto, (all of which are hereinafter referred to collectively
<br /> as the Improvements) at the cost of Grantee. The Grantee shall have the right to raake use of said
<br /> laad as is reasonebly necessary and advisable to the construction, installation, maintenance,
<br /> operation and repair of the Improvements.
<br /> In addition to any other remedy the Grantee may have, the covenants and
<br /> restrictions contained herein may be enforced by injunction.
<br /> Grantor covenants that it is in fee title ta the above property, has a lawful right and
<br /> authority to convey and grant this easement,and that the land is free from all encumbrances.
<br /> Grantee agrees that the improved surface af any trial within the easement will not exceed 8
<br /> fe,et in width and agrees that any improved trail within .the easement will be constructed
<br /> cantemporaueously with the installation of bollards and signage pmhibiting non-pedes�trian use of
<br /> the easement. Said signage, trail, easement area and mollards to be maintaiued by the 4rantee.
