� ' / <br /> August 11, 2014 <br /> Zoning Department <br /> City of Orono R��'�IV�` <br /> 2750 Kelley Parkway qU o <br /> Orono, MN 55345 L,� � �3?p14 <br /> 'YpF�Ro <br /> To Whom It May Concern, /�/0 <br /> It has come to our attenrion that Patrick Wa1sh, of 1390 Rest Point Road, has chosen to install a <br /> fence which is in clear violation of the 0-75' and the average lakeshore setback ordinances. <br /> Please see Photo 1 below wluch depicts the actual location of the fence (we have provided the <br /> photos since we know that Mr Oman has had 2 knee replacements and does not need ta be <br /> n�nning around, traipsing through peoples properties to take photos of actual code violations). <br /> It can also be seen that Mr Walsh has failed to put the "finished side towards his neighbor's <br /> property for a large portion of the fence as seen in Photo 2. Orono's fence ordinance requires <br /> that the finished side is put towards the neighbor's yard: <br /> "Materials and Maintenance <br /> Fences must be installed with the finished side facing neighboring properties or the street.The term <br /> "finished side"means that side having no structural supports" <br /> We could not find anywhere in the code where it states that a person does not have to put a <br /> fuushed side towards the neighbor's property if it is near an e�cisting structure. Furthermore, <br /> dangerous nails can be seen protiuding into the neighbors yard from the fence. We do not see <br /> how the neighbors could possibly maintain their house on that side without suffering <br /> potentially serious injuries. <br /> It also appears that the new deck Mr Walsh installed (was there a permit pulled for this deck as <br /> required by Orono code? Will there be an after the fact permit fee if none was pulled as <br /> required by Orono code?) has increased his hardcover on his already m�imized properry. As <br /> we all know, any increase in hardcover in the 0-75' setback area, no matter how trivial, is <br /> severely frowned upon by the City of Orono. <br /> Thank you for your concern, <br /> The Residents of Rest Point <br />
