The properiy is located in the LR 1B Single Family Lakeshore Residential Zoning <br /> District where the minimum lot area requirement is one acre. . <br /> 3. The Orono Planning Commission reviewed this application on June 16, 1997 and <br /> recommended unanimous approval of the proposed variances and conditional use <br /> permit based upon the following unique findings and hardships: <br /> a. The zoning lot does not meet minimum lot area, lot width or side yard <br /> requirements. <br /> b. The existing structure conforms to the average lakeshore setback but does <br /> not meet the 75' lakeshore setback. <br /> . . c. The topography of the zoning lot is within the floodplain in the middle of <br /> • � � the zoning lot. <br /> d. The Zoning Code allows 15% lot coverage. <br /> e. The existing hardcover in the 0-75' setback is 609.25 sq. ft. (9%). <br /> 4. The Council fmds that the conditions e�sting on this property are peculiar to it and <br /> do not apply generally to other property in this zoning district; that granting the <br /> variances would not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighboring properties, would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a demonstrable hardship <br /> or diff'iculty; is necessary to preserve a substantial properry right of the applicants; <br /> and would be in keeping with the spirit and intent of the Zoning Code and <br /> � Comprehensive Plan of the City. � . � <br /> 5. �'he City Council finds that granting a conditional use permit to allow land. <br /> alteration in the 0-75' setback and floodplain will not be detrimental to the health, <br /> safety or general welfare of the public, would not adversely affect light, air nor <br /> pose a fire hazard or other danger to neighboring properry, nor will its use <br /> depreciate sunounding property values and that the proposed level of use of the <br /> properry will be in keeping with the intent and objectives of the Zoning Code and <br /> • Com�rehensive Plan of the Ciry. <br /> Page 2 of 4 <br />
