The property is located in the LR-1B, Single Family Lakeshore Residential Zoning <br /> District where 1 acre is the minimum lot size and 140 feet is the minimum lot width. <br /> 3. The Planning Commission reviewed the application for variances and recommended <br /> approval by a vote of 7 to 0 based on the following findings and hardships: <br /> A. The lot was platted prior.to current zoning standards. <br /> B. Continued use of the property as residential is consistent with the zoning <br /> district and with the development of the surrounding properties. <br /> C. The City of Orono had approved variances in 1997 and 1998 to allow <br /> complete remodeling and additions to the existing cabin on the property,and <br /> approved variances to permit construction of the existing detached garage. <br /> • D. The restrictions placed on the existing garage have created a very unsafe <br /> situation for vehicles backing out of the driveway are blinded from view to <br /> oncoming traffic. Rest Point Road is a very narrow road that has a steep hill <br /> immediately west of Rahn's driveway. <br /> E. In October, 1998 (after final review of the 1997 and 1998 variance <br /> applications) Jim Hafner, District Technician for the Minnehaha Creek <br /> Watershed District, visited the site and made a finding that the area on the <br /> properry below the 931.5' elevation was,in fact,not directly connected to the <br /> 100 year floodplain of Lake Minnetonka. Prior to that the area was believed <br /> to be protected and development had occurred around that portion of the <br /> property. . . <br /> � F. The driveway access to the existing garage would�be removed to eliminate a <br /> second driveway access to the property. <br /> 4. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district;that granting the <br /> variances will not adversely affect traffic conditions,light,air,nor pose a fire hazard <br /> or other danger to neighboring property;would not merely serve as a convenience to � <br /> the applicants,but is necessary to alleviate a demonstrable hardship or difficulty; is <br /> ' necessary to preserve a substantial property right of the applicants; and would be in <br /> • keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> Page 2 of 7 <br />
