The property has a very steep lakeshore. The existing stairs to the lake are <br /> cut into the slope and constructed over the previous set of stairs. The flat � <br /> portion of the lake yard drains toward the top of the stairs. <br /> b. The proposed stairs are to be located over the existing stairs, which would <br /> stay in place. They will be constructed above grade. <br /> c. The City Engineer has deterrnined that it would be extremely difficult to <br /> remove the existing stairs and stabilize the area. <br /> d. The City Engineer has determined it would be impossible to remove <br /> unneeded portions of the existing lower landing without reconstructing the <br /> six foot high retaining wall that forms the back of this landing. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the applicants and the public, and the effect of the proposed variances on <br /> the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owners but are necessary to alleviate a <br /> demonstr�ble hardship or difficulty; is necessary to preserve a substantial <br /> property right of the Owners; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby gra.nts a variance to Orono <br /> Municipal Zoning Code Section 78-967 to allow construction of new steps to the lake over the <br /> existing steps to the lake with a 0 setback from the southwesterly side property line when a 10 <br /> foot setback is required and a hardcover variance to allow two 40 square foot landings in the <br /> stairs when the maximum allowed is 32 square feet, subject to the following conditions: <br /> 1. Council approval is based on the site plan submitted by the Owners and <br /> annotated by City staff, attached to this Resolution as Exhibit A. Any <br /> amendmex�ts to this may require further Planning Commission and City <br /> Council review. <br /> Page 2 of 4 <br />
