/ �-�--� <br /> � ' v <br /> � O <br /> �.b. - C ITY of 4RON0 <br /> � � <br /> ti <br /> �,� �'� RESOLUTION OF THE CITY COUNCiI. <br /> t9kESH�4� NO. � � ���' `>� <br /> � A RESOLUTION GRANTING <br /> AFTER-THE-FACT VARIANCES TO <br /> MUNICIPAL ZONPi TG CODE <br /> SECTION 10.22, SUBDIVISION 2 AND <br /> SECTION 10.56, SUBDIVISION 16 (L) (2) <br /> F1I.E #2444 <br /> WHEREAS, Brian Schebler and Susan Schebler (hereinafter "the applicants") <br /> are owners of the property located at 1354 Rest Point Circle within the City of Orono <br /> (hereinafter "City") and legally described as follows: <br /> Lot 11, Subdivision of Lot 14, Rest Point Park Lake Minnetonka and Lot 13, Rest <br /> Point Park, Hennepin County, Minnesota (hereinafter "the property"); and _ <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held public hearings on March 15, 1999 and April 19, 1999, at which times all <br /> persons desiring to be heard concerning this application were given the opportunity to speak <br /> thereon; and <br /> WHEREAS,' the applicants have applied to the City for variances to Municipal <br /> Zonin; Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (2) to permit <br /> an after-the-fact variance for a 12'x16' lakeside deck to exceed allowed hardcover in the 75- <br /> 250' lakeshore setback. The hardcover is 5,593 sq. ft. (29.9%) where 4,675 sq. ft. (25%) is <br /> allowed. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2444. <br /> 2. The property is located in the LR-1B Zoning District, where 1 acre or 43,560 <br /> sq. ft. is the minimum lot area. The property consists of .72 acre or 31,200 sq. <br /> ft. <br /> Page 1 of 5 <br />
