Owners have fited Building Permit Applica6on #2012-00072 and Zoning Applicatan #11-3527 <br /> fom�ally requ�esting the City to review plans fo�a scree� porch and garage adddions loca�ed at 2690 Rainey Raad. <br /> the 'Subj�ct ProperE�') legally described as Lot 3, Block 2, Trees to Be, together with the appurtenant <br /> easement(s) contained in Document No. 5441457, according to the reco�ded plat thereof or�file and of record in <br /> the office of the County Recorder, Hennepin Courrty, Minnesata. <br /> 2. Ovmers request the�City to review saicf.plans which requires City approva! inGuding a variance <br /> and bu�ding permit <br /> _ _ - - � ' ' �' <br /> 3. The'City is wiqing to oommence its review of the applicatan and incur oosts assocfated with said <br /> review only if the Owners establish an escrow to ensure reimbursement to the City of its costs. <br /> NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS: <br /> 1. DEPOSIT OF ESCROW `FUNDS. Contemporaneously with the execution of this Escrow <br /> Agreement, the Owners shall deposit$2,500 with the City. AA accrued interest, if any,shatl be paid to the City to <br /> reimburse the City for its cost in adminisbering the escro�w accouM. <br /> 2. PURPOSE OF F_SCROW. The purpose of the escrow is to guarantee reimbursement ta the City <br /> for all aut-�f-pocket costs the City has incuRed (induding planning, engineering, or legaf consultant review)or will <br /> incur,.in meeting with the Owners, reviewing ti�e plans, and preparing agenda packet material fcr City Council <br /> review of building permit apptication #2012-OOa72 and varianee application 11-3527. Eligible expenses shalt be <br /> consistent w�th e�enses the Owners would be responsible,for under a zoning and subdivision applicafion. <br /> 3. MONTHLY 61LLING. As the City recenres consultant bills for incumed cosfs, the City will in turn <br /> send:a bill to the Owners. Owners shall be responsible for payment to the City wdhir� 30 days of the Owners' <br /> �receipt of bilL . � <br /> � 4. DiSBIIRSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make <br /> payment to the City within the timeframe outlined in #3 above, shall cease all reviews urrtil the Owners pay all <br /> expenses invoiced pursuarrt to#3. The City may draw frflm the escrow account wiiha.ut further approval of the <br /> Owners to reimburse the City fo�efigible expenses the.City has incurred_ <br /> 5. CLOSING ESCROW.
