There is no additional land available to bring the lot area into conformity. <br /> b. The Property is 2.2 acres in area and has 220' of width. <br /> c. The Property abuts a private road outlot legally described as Outlot C, Trees <br /> To Be. <br /> d. Although underlain with City road easements, Outlot C is currently and <br /> indefinitely not used as a traveled road, has not been developed for road <br /> purposes, and is heavily vegetated. <br /> e. The location of the septic mound site and septic tank limit the areas of <br /> expansion for the Applicants' home. <br /> f. The Applicants revised their initial request so that the proposed addition will <br /> meet a 40' side street setback from Outlot C. <br /> g. The Property has a dense cover of trees, hiding the proposed addition from <br /> both Outlot C and from Rainey Road. <br /> h. The Applicants' request will alleviate a practical difficulty inherent to the <br /> Property and not created by the Applicants. <br /> i. The Applicants' request will not alter the essential character of the <br /> neighborhood and will result in minimal negative impact on adjacent <br /> properties. <br /> j. The Applicants' request is in harmony with the purpose and intent of the <br /> ordinance. <br /> k. The Applicants have demonstrated that enforcing the setback provisions of the <br /> Zoning Ordinance deprive the Applicants of the reasonable use of their <br /> Property. <br /> 5. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments by <br /> the Applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> Page 2 of 4 <br />
