"The conditions do not apply generally to other land or structures in the district in which the <br /> land is loaated." The proposed home with the addition will be generally in line with the <br /> neighboriMg homes with respect to size and setback. <br /> 10. "The gran�ing of the application is necessary for the p�eservation and enjoyment of a <br /> substantial property right of the applicant." The Applicants have indicated that this criterion <br /> is met. <br /> 11. "The gran�ng of the proposed variance will not in any way impair health, safety, comfort or <br /> morals, or in any other respect be contrary to the intent of this chapter." Granting the <br /> requested variances will not adversely impact health, safety, comfort, or morals; nor will it <br /> be contrary to the intent of the Code. <br /> 12. "The granting of such variance will not merely serve as a convenience to the applicant, but <br /> is necessary to alleviate demonstrable difficulty."The three street frontages, the <br /> substandard size and width of the Property combined with the 2-acre district setbacks <br /> create praCtical difficulties affecting the Property; the variances are necessary and not <br /> merely ser+ve as a convenience to the Applicants. <br /> , CONCLUSIONS. ORDER AND CONDITIONS: <br /> Based upqn one or more of the above findings, the Orono City Council hereby grants a <br /> variance to Oronoj Municipal Zoning Code Section 78-420 to allow construction of an addition to <br /> the existing home 118 feet from the side street where a 50-foot setback is required, and 17.9 feet <br /> from the side lot lirhe where a 30-foot setback is required, subject to the following conditions: <br /> 1. Council approval is based on the survey dated June 3, 2016 by Willis L. Gilliard and <br /> building pl�ns submitted by the Applicants and annotated by City staff, attached to this <br /> Resolution;as Exhibits A 8� B. Any amendments to the plans which are not in conformity <br /> with City codes may require further Ptanning Commission and City Council review. <br /> 2. The existing shed on the east side lot line of the Property shall be removed prior to the <br /> framing inspection for the addition. <br /> 3. Authorities granted by this resolution run with the Property not with the Applicants, but are <br /> permissive �only and must be exercised by obtaining a building permit for the new <br /> constructiorh and commencing construction of said project. A framing inspection must be <br /> completed writhin one year of the date of Council approval, or the variance will expire on <br /> that date (Flebruary 13, 2018). <br /> 4 <br /> I <br />
